Need help-where to start when cyst/tumor removed not sent to pathology?

I had a mass discovered on my right front shoulder by a massage therapist (I had been having shoulder blade pain). Ortho thought it was a ganglion cyst, then lipoma. Had xray & ultrasound was inconclusive per radiology. Was removed in August 2008 along with bone spurs filed down. Kept asking for pathology report ... told it "looked" benign. Requested OR records and found it was not sent to pathology in error. Doc still said it looked benign, but I have no closure and have not figured out what to do. I don't think I should have to pay to make sure it isn't cancer, but also don't think I should wait much longer. Is the hospital/doctor responsible? Thanks for any suggestions on where to begin.

  • Is the hospital/doctor responsible? If something bad happens to you, then yes, the hosp./doc can possibly (probably, in your case) be held responsible. If nothing bad has happened to you, then there is no negligence. Stupidity, yes, but no negligence....

Thanks for any suggestions on where to begin.I had the same happen to me. Had the hospital E.R. investigated and they were given slap on the hand. However, 9 months later I found new growth and it has turned out to be stage 3 cancer. Have yourself re-tested immediately! You will never find a lawyer or hospital administrator willing to take a case or opt to pay for re-testing. I beg you do it for yourself. NOW!
