MRI Incorrect

I had a MRI taken and the findings were incorrect and said that I had mild arthritis and swelling. So every doctor that I saw for 2 years said I was faking my pain and nothing was wrong. I took the film to a surgeon who was head of Duke's Surgical Team and in one minute he diagnosed that I had labral tear, rotator cuff tear, bursitis, and some other things. What can I do for the MRI place's wrong reading that caused me financial ruin and prolonged pain. Do I have reason for medical malpractice?

  • I certainly understand how you feel. However, my guess is no. I think that perfection is not required. Negligence would have to be proven. As horrible as reading an MRI incorrectly is, I'm not sure it would fall under negligence. And since it did not cause you injury, only loss of money, I'm not sure if that would be cause for malpractice. But no harm in talking to an attorney.
