Delayed union not caught by MD

I had a tibial shaft fx with fibula fx in Nov with ORIF rod and screw placment. After 3 months I had a significant increase in pain, swelling and dissability. Could not get appontments with MD so went to ER and was told the bones were not healed. Continued with pain so went to PCP who did not like the healing of the bones. I finnaly got in to the otrho who took new pictures and exclaimed how happy he was with my healing. Later the same day I got a new ortho who took one look at my x-rays and sent me for a CT with the diagnosis of delayed union. Apparently I have had no healing of either bone after 4 months. Going to do a procedure called dynimizing the rod, but the new doc does not hold out much hope for this stating that it should have been done months ago. What do you do when your doctor fails to catch something so simple and dooms your recovery because of it. If this procedure does not work I will have to have a rod exchange and re reaming with bone grafting. Just realy put out right now.
